Claims against insurance brokers on the rise in Ontario

Injury Lawyers Ottawa - QTMG LLP Over the course of our practice and since the legislative changes to the SABS which came into effect on September 1, 2010, we have noted a considerable increase in the number of inquiries about whether or not an insured can initiate an action against his insurance broker for his failure to inform and offer optional benefits in subsequent insurance policy renewal applications. This new trend appears to be a direct side effect caused by the changes to the available accident benefits previously offered under a basic insurance policy. Under the right circumstances, insured's who feel they have been deprived of the opportunity to purchase optional benefits and who now find themselves under insured can initiate an action based in negligence against their broker.
